Following numerous criminal and drug-related offenses and community complaints, Burke County Sheriff Banks Hinceman enlisted the help of the Alcohol Law Enforcement Division to address a property at 1936 US 64, Morganton. A collaborative investigation led to Superior Court Judge Daniel Kuehnert issuing a Consent Judgment and final order of abatement.
This judgment concludes a civil nuisance abatement investigation initiated by Burke County on behalf of North Carolina. Chapter 19 of the North Carolina General Statutes addresses nuisance activities, which include drug law violations, violence, and peace breaches, permitting a civil remedy to eradicate these criminal acts from communities.
"The Burke County Sheriff’s Office is appreciative of the partnership with North Carolina Alcohol Law Enforcement," stated Sheriff Hinceman. He added that the collaborative efforts of the ALE’s Nuisance Abatement Team and other local authorities targeted a crime hub in the Salem Community. "This resolution will make the neighborhood a much safer place to live by reducing the crime in the area."
The judgment was agreed upon by all parties involved. It stipulates that the property be transferred to a responsible family member, prohibits future nuisance activities, and mandates the permanent removal of all nonresidents. Defendants retain living rights but must engage in drug treatment programs.
